TERMS & CONDITIONS

NOTICE TO CONSUMER

For a qualifying New Jersey home-improvement contract, you have the right to cancel the contract for any reason before midnight of the third business day after you receive a copy of the contract.

To cancel, you must provide Beach Blinds & Shutters with a signed and dated written notice of cancellation within the required cancellation period. The notice may be sent by registered or certified mail, return receipt requested, or personally delivered as permitted by New Jersey law.

If you properly cancel within the three-business-day period, all money you paid, including your deposit, will be fully refunded within 30 days after Beach Blinds & Shutters receives your cancellation notice. If financing or a credit agreement was arranged through the contractor for the transaction, applicable cancellation rights will also be honored as required by law. 

Important: New Jersey requires a particular statutory “Notice to Consumer” to appear conspicuously in qualifying home-improvement contracts in at least 10-point bold type. This website version should not be used as a substitute for the exact notice required in the customer’s signed contract. 

1. Custom Products and Special Orders

Blinds, shades, shutters, top treatments, motorized products, specialty products, and other window treatments may be custom manufactured specifically for the customer’s windows and selections.

After the legally required cancellation period has expired and an order has been released to the manufacturer or supplier, custom products generally cannot be canceled, changed, returned, exchanged, or refunded, except where required by law, covered by an applicable warranty, or resulting from an error for which Beach Blinds & Shutters or the manufacturer is responsible.

2. Measurements

Measurements performed by Beach Blinds & Shutters will be used to prepare and order the customer’s products.

If Beach Blinds & Shutters is responsible for measuring and a product is manufactured incorrectly because of an error in those measurements, Beach Blinds & Shutters will work to have the affected product corrected or remade.

If a customer supplies measurements or chooses to measure for a self-installation order, the customer is responsible for the accuracy of those measurements. Products ordered from customer-provided measurements cannot generally be returned or remade at Beach Blinds & Shutters’ expense because of a customer’s measuring error.

3. Product Selection and Customer Approval

Customers are responsible for reviewing their selections before the order is submitted, including product type, style, material, color, operating system, mount, control location, quantity, and other specifications.

Colors and materials may vary slightly from samples, displays, photographs, screens, or previously manufactured products because of dye lots, natural material variation, lighting, and manufacturing differences.

4. Estimates and Pricing

Quotes and estimates are based on the products, measurements, installation requirements, and information available when the estimate is prepared.

Prices may change if measurements, quantities, products, installation conditions, customer selections, freight charges, manufacturer pricing, or the scope of work changes before the order is finalized.

The customer’s final written sales agreement or invoice will control the price of the order.

5. Deposits and Payments

Unless otherwise stated in writing, professionally installed custom orders generally require a 60% deposit when the order is placed.

Approximately 30% may be due when the merchandise arrives or is delivered, with the remaining balance due at or by completion of installation, according to the customer’s invoice or sales agreement.

Self-installation, special-order, or online orders may require payment in full when ordered.

6. Returned or Failed Payments

A $50 returned-payment fee may be charged for a returned check, rejected electronic payment, stopped payment, reversed payment, or other failed payment, to the extent permitted by applicable law.

The underlying balance remains due.

7. Production and Estimated Lead Times

Many products may typically be produced in approximately two to three weeks, but all manufacturing, shipping, delivery, and installation timeframes are estimates unless specifically guaranteed in writing.

Custom products may take longer because of manufacturer schedules, material availability, holidays, freight issues, weather, product complexity, backorders, or circumstances outside the reasonable control of Beach Blinds & Shutters.

8. Manufacturer or Shipping Delays

Beach Blinds & Shutters is not responsible for reasonable delays caused by manufacturers, suppliers, freight companies, material shortages, weather, transportation interruptions, labor disruptions, acts of government, natural disasters, or other circumstances beyond its reasonable control.

A manufacturer or shipping delay does not automatically create a right to cancel a custom order after the legally applicable cancellation period has expired.

9. Manufacturer Errors, Damage, and Defects

If merchandise arrives damaged, defective, incorrectly manufactured, or inconsistent with the approved order, Beach Blinds & Shutters will work with the manufacturer or supplier to obtain an appropriate repair, replacement, remake, part, or other available remedy.

A manufacturer’s need to remake or replace an affected product does not necessarily require cancellation or refund of unaffected portions of the order.

10. Installation

Installation will normally be scheduled after the merchandise has arrived and been inspected or determined ready for installation.

Customers must provide reasonable and safe access to the windows and installation areas. Furniture, valuables, fragile items, decorations, electronics, and other obstructions should be moved before the installer arrives when reasonably necessary.

Additional visits required because access was unavailable, construction was incomplete, the customer was unavailable, or conditions were not ready for installation may result in an additional service charge.

11. Installation Concerns

Customers are encouraged to inspect the installation upon completion.

Any visible installation or workmanship concern should be reported to Beach Blinds & Shutters as soon as possible, preferably within 48 hours, so the matter can be inspected and addressed promptly.

Beach Blinds & Shutters will make reasonable efforts to correct verified workmanship problems attributable to its installation.

12. Product and Manufacturer Warranties

Many products are protected by a manufacturer’s warranty. Warranty length and coverage vary by manufacturer and product; some products may carry warranties of approximately five years or other periods.

The manufacturer’s written warranty controls manufacturer warranty claims.

Warranty coverage generally does not include normal wear, misuse, abuse, improper cleaning, accidents, alterations, damage caused by pets or children, water or moisture damage, building movement, improper customer installation, or work performed by third parties unless the applicable warranty provides otherwise.

13. Independent Installers and Subcontractors

Beach Blinds & Shutters may use qualified independent installers, technicians, or subcontractors to perform installation, measurement, service, or related work.

The use of an independent installer does not change the customer’s payment obligations under the applicable sales agreement.

14. Additional Service, Travel, and Return-Visit Charges

Reasonable additional fees may apply for service outside the normal service area, unusually difficult installations, customer-requested changes, return visits caused by conditions outside Beach Blinds & Shutters’ control, or services not included in the original agreement.

Any material additional charge should be communicated to the customer before the additional work is performed whenever reasonably practical.

15. Changes to an Order

Any requested change to an order should be made before the order is submitted to the manufacturer.

Once production has begun, manufacturers may refuse changes or may charge additional fees. If a change is possible, the customer is responsible for any resulting price difference, manufacturer fee, freight charge, additional labor, or other reasonable cost associated with the requested change.

16. Cancellation After the Three-Business-Day Period

After the legally required cancellation period has expired, a customer may contact Beach Blinds & Shutters to determine whether an order has already been released to the manufacturer.

If the order has not yet been submitted, Beach Blinds & Shutters may agree to cancellation subject to costs already reasonably incurred and applicable law.

Once a custom order has been submitted for manufacturing, it is generally non-cancelable and non-refundable, except where applicable law provides otherwise.

Nothing in these Terms & Conditions is intended to waive or restrict any cancellation, refund, warranty, or other consumer right that cannot legally be waived.

17. Acceptance of Terms

By signing or approving a sales agreement, estimate, invoice, or order; paying a deposit; authorizing Beach Blinds & Shutters to place an order; or accepting products or services, the customer agrees to the applicable written terms of the transaction.
